Section 1 — Parties & Agreement
This Vehicle Rental Agreement is entered into between Suncoast Elite Fleet LLC ("Company") and the individual renter ("Renter") identified at the time of signing. The Agreement Date, vehicle details, and renter information are documented at the time of rental. The Renter must provide a valid driver's license, proof of gig platform enrollment, and all required documentation prior to vehicle delivery.
Section 2 — Rental Terms & Fees
Rental rates are agreed upon at the time of signing. The standard mileage allowance is 400 miles per week; overage is charged at $0.15/mile. A late return fee of $25/hour applies after a 1-hour grace period. Payment is due every Monday by 9:00 AM. Renter agrees to pay the weekly rate in advance. Failure to pay by the due date constitutes a breach of this Agreement and entitles the Company to immediately repossess the vehicle without further notice.
Section 3 — Authorized Use & Restrictions
The vehicle may be used for personal transportation and approved gig platform driving (Uber, Lyft, DoorDash, Instacart, and similar). Renters must maintain an active, valid driver's license for the entire rental period. The vehicle must remain within the continental United States unless written permission is granted by the Company.
Section 4 — Prohibited Uses
The following uses are strictly prohibited: subletting, loaning, or transferring use of the vehicle to any unauthorized driver; use in any race, speed test, or off-road activity; use to transport illegal substances, contraband, or weapons; towing or hauling any trailer or vehicle without written authorization; driving under the influence of alcohol, drugs, or any impairing substance; driving outside the authorized geographic area without prior written consent; allowing any person other than the Renter to operate the vehicle; use for any criminal activity or purpose.
Section 5 — Insurance & Liability
The Company maintains a commercial auto insurance policy on the vehicle. Coverage details are available upon request. Company coverage does NOT extend to personal liability of the Renter beyond minimum statutory requirements. Renter is REQUIRED to maintain active rideshare/delivery driver insurance through their gig platform (Uber, Lyft, etc.) for Period 1, 2, and 3 coverage as applicable. Renter must provide proof of gig platform insurance enrollment before vehicle delivery. Renter is personally liable for any gap in coverage. Renter is solely liable for all traffic citations, toll violations, and parking tickets incurred during the rental period. A $35 administrative fee applies to each toll or citation the Company receives and must pay on Renter's behalf.
Section 6 — Damage, Accidents & Incidents
Both parties will conduct a vehicle inspection at check-out. Any pre-existing damage will be documented in writing and by photographs. Renter must notify the Company within 2 hours of any accident, collision, or incident involving the vehicle. Renter must file a police report for any accident, theft, vandalism, or hit-and-run. Renter is responsible for the cost of repair for all damage occurring during the rental period not covered by insurance, including interior damage, tire damage, rim damage, glass damage, and damage resulting from prohibited use. Failure to report an incident is a material breach of this Agreement.
Section 7 — Security Deposit
A refundable security deposit is required prior to vehicle delivery. The deposit will be returned within 5 business days of vehicle return, less any deductions for: unpaid rental fees or late fees; traffic citations, tolls, or parking tickets; vehicle damage beyond normal wear and tear; missing items (keys, phone chargers, floor mats, etc.); excessive cleaning fees (interior soiling, odor, pet hair, etc.); and administrative fees incurred on Renter's behalf. The Company will provide an itemized statement of any deductions.
Section 8 — Vehicle Maintenance & Condition
Renter must check and maintain proper tire pressure, oil, and fluid levels throughout the rental. Renter must notify the Company immediately if any warning light activates or any mechanical issue arises. Renter must NOT attempt to repair the vehicle or authorize third-party repairs without Company approval. Vehicle must be returned in clean condition — a cleaning fee of $75–$150 will apply for excessive mess. Vehicle must be returned with the same fuel level as at check-out; a $10 service fee plus cost of fuel applies if returned below that level.
Section 9 — Termination & Repossession
Renter may terminate this Agreement with 48 hours written notice. Prepaid rental fees for unused days will be refunded at the Company's discretion based on the length of notice provided. The Company may terminate this Agreement immediately and repossess the vehicle, without liability, if: Renter fails to make timely payment; Renter violates any term of this Agreement; Renter's driver license is suspended, revoked, or expired; Renter is involved in an unreported accident or criminal activity; Renter's gig platform account is deactivated; or the Company determines in good faith the vehicle is at risk of damage or loss. Upon termination, Renter must return the vehicle immediately. Failure to return the vehicle within 24 hours of demand constitutes unauthorized use and will be reported to law enforcement as theft.
Section 10 — General Provisions
This Agreement shall be governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Flagler County, Florida. This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions. Modifications must be in writing and signed by both parties. If any provision of this Agreement is found unenforceable, the remaining provisions remain in full force and effect. The parties agree that electronic signatures are valid and binding to the same extent as original signatures.
Acknowledgment & Signatures
By signing the rental agreement, both parties confirm they have read, understood, and agreed to all terms. Renter acknowledges they have inspected the vehicle, received a copy of this Agreement, understand that violation of any term may result in immediate repossession without refund, and carry valid gig platform insurance coverage for the authorized use of the vehicle.
